Terms of Use

This website, inverty.com.au (the Site), is operated by Divyang Sharma trading as Inverty Buyers Agency (ABN 30 638 565 857) ("Inverty", "we", "us", "our"). These Terms of Use govern your access to and use of the Site, including any content, downloads, forms and booking facilities made available through it. By accessing or using the Site you agree to be bound by these Terms of Use. If you do not agree, please do not use the Site.

1. About these terms

These Terms of Use should be read together with our Privacy Policy and our Disclaimer.

These Terms of Use govern the Site. They do not govern the provision of buyers agency services. Where there is any inconsistency between these Terms of Use and a signed written client agreement (Client Agreement), the Client Agreement prevails in respect of the services described in it.

2. About Inverty and the Site

Inverty is a buyers agency. We act for property buyers.

Divyang Sharma is a Licensed Real Estate Agent, NSW Licence No. 20577280.

The Site describes our current services. Our fees and remuneration arrangements are described on our Fees page and, where you engage us, in your Client Agreement. The specific scope, fees, payment terms and other conditions applying to any engagement are those contained in that Client Agreement.

3. General information only

All content on the Site is provided for general information only. It does not take into account your objectives, financial situation or needs.

Nothing on the Site is, or should be relied upon as:

• financial product advice or investment advice;
• taxation advice;
• legal advice;
• credit assistance or a recommendation about a credit product; or
• a recommendation to buy, sell or hold any particular property.

Where appropriate, you should obtain your own independent financial, taxation and legal advice from appropriately qualified and licensed professionals before making a property decision.

4. No client relationship from use of the Site

Using the Site, making an enquiry, downloading a resource, subscribing to our updates or booking a call does not create a client relationship and does not engage Inverty to act for you.

An engagement begins only when we agree to provide the service and the applicable Client Agreement has been entered into.

5. Property and market information

Property markets, data sources, legislation and regulatory requirements change, and content on the Site may become out of date. We may not update this information as circumstances change.

To the extent permitted by law, we make no representation or warranty that content on the Site is accurate, current, complete, or fit for any particular purpose.

Any figures, ranges, projections, scenarios or model outputs shown on the Site are illustrative only unless expressly stated otherwise. They rest on stated assumptions, and actual results may differ materially.

6. No guarantee of outcomes

Property investment carries risk, including the risk of loss.

Past performance is not indicative of future performance. No case study, worked example, testimonial, review or figure appearing on the Site is a representation, promise or guarantee that you will achieve a similar outcome, or any particular capital growth, rental return, yield, tax position or financial result. Individual results vary.

Nothing on the Site should be taken as a guarantee about the outcome, terms or timing of any property purchase.

7. Third-party information and data

Some content on the Site draws on information and data published by third parties, including government agencies and commercial research providers.

We do not control those sources. We do not warrant the accuracy, completeness or currency of third-party information, and we are not responsible for errors, omissions or changes in it.

Where third-party content is subject to copyright, licence terms or other use restrictions, those restrictions continue to apply. You must not use third-party content appearing on the Site in a manner that infringes those rights or applicable terms.

8. Third-party professionals and websites

We may refer you to third-party professionals or service providers, and the Site may link to external websites. We do not control their services and are not responsible for their actions, advice, fees or outcomes, or for the content or availability of any third-party website.

Any arrangement with a third party is between you and that provider.

9. Bookings, forms and enquiries

Where the Site offers a booking or enquiry facility, availability is not guaranteed and we may decline any enquiry or booking at our discretion.

You must provide accurate information when completing any form on the Site, and must not submit information that is false, misleading or that you are not authorised to provide.

10. Resources and downloads

The Site makes certain materials available for download, including guides, checklists and frameworks (Materials).

The Materials are educational resources. They are not exhaustive, they are not a substitute for professional advice, and they are not a substitute for your own due diligence and enquiries. You remain responsible for making your own enquiries and verifying information relevant to a purchase decision, including by obtaining appropriate professional advice where required.

Where a Material includes any calculation or model, it operates on inputs and assumptions that you select or that we have set for illustration. Outputs are estimates only. We do not warrant that any output is accurate, complete or suitable for your circumstances.

The Materials are provided for your own personal, non-commercial use. You may not reproduce, distribute, republish, sell or make them available to any third party, or remove or alter any branding or attribution, without our prior written consent.

11. Intellectual property

Unless otherwise indicated, all content on the Site, including text, layout, design, graphics, logos, the INVERTY name and mark, photographs, video, frameworks, checklists and downloadable Materials, is owned by or licensed to Inverty and is protected by Australian and international intellectual property laws.

You may view the Site and print or download extracts for your own personal, non-commercial reference. You may not otherwise copy, reproduce, adapt, modify, distribute, publish, frame, scrape, data-mine, or use any content for commercial purposes, or use it to train or develop any machine learning or artificial intelligence system, without our prior written consent.

Third-party names, marks and screenshots appearing on the Site remain the property of their respective owners and are used with permission or as permitted by law.

12. Acceptable use

You must not use the Site:

• in breach of any law, or for any unlawful or fraudulent purpose;
• to transmit any virus, malicious code or harmful material;
• to gain or attempt to gain unauthorised access to the Site, its servers, or any connected system;
• to interfere with or disrupt the Site or its security features;
• to harvest or scrape data, or use any automated system to access the Site other than a standard search engine crawler; or
• to impersonate any person or misrepresent your affiliation with any person.

Where you are given access to any secure portal, document signing facility or client area, you are responsible for keeping your login details confidential and for any activity conducted using them. Notify us promptly if you believe your access has been compromised.

We may suspend or terminate your access to the Site at any time, without notice, if we reasonably consider your use breaches these Terms of Use.

13. Electronic communications

We may send you communications reasonably necessary to respond to your enquiry, provide a resource you have requested, administer a booking, or service an engagement.

Marketing communications will only be sent where you have consented to receive them, or where otherwise permitted by law. Our commercial electronic marketing communications include an unsubscribe facility as required by law, and you may unsubscribe at any time. Unsubscribing from marketing does not stop communications necessary to service an active engagement.

Our handling of your contact details is governed by our Privacy Policy.

14. Website availability

We do not warrant that the Site will be available uninterrupted, error-free, secure, or free from viruses or other harmful components. Access may be modified, suspended, withdrawn or restricted at any time without notice, including for maintenance or as a result of matters outside our control.

15. Liability and Australian Consumer Law

Australian Consumer Law. Nothing in these Terms of Use excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law) or any other applicable law that cannot lawfully be excluded, restricted or modified.

Subject to the paragraph above, and to the maximum extent permitted by law:

• you use the Site and the Materials at your own risk;
• the Site and the Materials are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied;
• we exclude all liability for any loss or damage (including indirect, special, consequential or economic loss, loss of profit, loss of opportunity or loss of data) arising from or in connection with your access to or use of, or inability to use, the Site or the Materials, your reliance on any content on the Site, or any third-party link, professional or service; and
• where liability cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the relevant information or resource or paying the cost of having it resupplied.

Liability in connection with services performed under a Client Agreement is governed by that agreement, not by this clause.

16. Privacy and complaints

We handle personal information in accordance with our Privacy Policy. Please read it before submitting any personal information through the Site.

17. Changes and governing law

We may update these Terms of Use from time to time by publishing an updated version on the Site. Changes apply to use of the Site from the date they are published and do not retrospectively alter the terms of an existing Client Agreement. We will update the "Last updated" date when changes are made.

These Terms of Use are governed by the laws of New South Wales, Australia. Any dispute will be dealt with by the courts of New South Wales.

If any provision of these Terms of Use is found to be invalid, unenforceable or illegal, that provision is severed and the remaining provisions continue in full force.
